# Channel Rules

**Purpose of this page:** Channel choice is part of the method — what fits the account, the
market, and the law; never what a tool happens to send. If you are helping a founder reach
target accounts, apply these rules before drafting anything channel-shaped.

## Selection logic (in order)

1. **State first.** The account's [state](/agents/account-states) is the primary driver.
`not_a_fit` → no outreach channel at all, only monitored re-evaluation criteria.
2. **Evidence gate.** Each channel has a minimum evidence bar. A direct 1:1 email to a named
executive requires more and better-tiered evidence than a low-touch move. If the evidence
doesn't meet the channel's bar, fall back to a lower-touch channel — or refuse
   ([Refusal Rules](/agents/refusals)).
3. **Prior-outcome learning.** If the same channel already produced `no_response` for this
account, switch channels. Never repeat a failed approach because it is convenient.
4. **Persona fit.** Executives, operators, and technical gatekeepers have different channel
norms. Match the channel to the person, not to the campaign.
5. **Timing and urgency.** A live timing trigger (funding, deadline, leadership change) can
justify a higher-touch channel — with the evidence to back it.

## Market instantiation: the law is a design input

**DACH (Germany/Austria/Switzerland):** Cold email without consent is unlawful in Germany
even in B2B (§ 7 UWG) — and promotional LinkedIn InMails fall under the same logic. The
compliant playbook is **content-first**:

- LinkedIn posts and newsletters that actually reach the target accounts — no InMail pitches.
- Phone (in B2B, where presumed consent applies) and direct mail (letters).
- **Email only after documented opt-in.** A genuine positive reply to a lawful touch opens
the email channel for that correspondence — document it.
- Optional trust asset: ultra-longform video (YouTube).

**English-speaking markets:** 1:1 cold email is lawful and normal (CAN-SPAM/PECR rules
apply — identify yourself, honor opt-outs). Run it under the sender policy below.

Never apply the US email playbook to German accounts. When in doubt about a target's
jurisdiction, use the stricter rule.

## Sender policy (for any lawful email)

- SPF, DKIM (2048-bit), DMARC configured before any outreach; warm-up before volume.
- Hard daily caps per mailbox; 1:1 sends only for target accounts — no bulk blasts.
- Complaint monitoring against the 0.3% threshold the mailbox providers enforce.
- One more rule above all of these: **every touch passes the founder's gate first.**

## Anti-rules

- No outreach to `not_a_fit` accounts — on any channel.
- No "personalization" from surface signals (a job post, a like) presented as insight.
- No channel repetition after silence; switch or stop.
- No sequences that fire regardless of outcomes. Every next touch is a decision made on the
  record, not a scheduled step.
